The Office of the Representative on International Legal Affairs welcomes the decision of the International Court of Justice of November 12, 2024, in which the court ultimately rejected the preliminary objections submitted by Azerbaijan in the case of "Armenia v. Azerbaijan" submitted under the Convention on the Elimination of All Forms of Discrimination.
The Court, in particular, found that the conditions stipulated by Article 22 of the Convention were met. In particular, Armenia negotiated in good faith, and the convention applied to the negotiated issues. At the time of Armenia's complaint on September 16, 2021, the negotiations failed.
The court also ultimately rejected Azerbaijan's preliminary objections regarding the court's subject matter jurisdiction (ratione materiae). In particular, the court noted that Armenia's claims related to the killings, torture, and inhumane treatment of ethnic Armenians by Azerbaijan, as well as the arrests and forced disappearances, stem from the convention.
