The General Prosecutor's Office informed on April 17 that a public criminal prosecution was initiated against Azerbaijani citizens Agshin Babirov and Hussein Akhundov. They were detained.
According to the criminal proceedings investigated by the central investigation department of the RA National Security Service, it was also found that the citizen of the Republic of Azerbaijan, Hussein Akhundov, on April 12, 2023, arriving at the guard post "Zangezuri Copper-Molybdenum Combine" CJSC located in the Shgharshik settlement of the Kapan municipality of the Syunik region, the guard of the said guard post was an RA citizen. With selfish motives to steal H.M.'s mobile phone and car, later again to facilitate the criminal act of illegally crossing the RA state border to reach the Islamic Republic of Iran, as well as to illegally deprive his life with the motive of national hatred, intolerance, and hostility, shots from his illegally kept rifle fired in the direction of RA citizen H.M., who is guarding "Zangezur Copper-Molybdenum Combine" CJSC and is near the guard post. H.M. died on the spot from the injuries he received.
Then, Hussein Akhundov stole the mobile phone, cigarette, and lighter lying next to H.M.'s body, tried to start the parked car's engine but could not, and fled. Akhundov, leaving the scene of the incident, shot a video message using the stolen mobile phone, saying: "(...) thanks to God, we successfully reached Armenia and beheaded 400 to 500 Armenians, we are not traitors, and we hope to return to Azerbaijan (...) successfully". Then, Akhundov downloaded an Internet application on the stolen mobile phone and posted the recorded video message on his social network page. After that, Akhundov went on foot in the direction of the village of Achanan in the Syunik region and was found on April 13, 2023, by passers-by who, finding out that he was an employee of the Armed Forces of Azerbaijan, neutralized him and handed him over to the law enforcement agencies of the Republic of Armenia.
Based on the factual data obtained in the criminal proceedings, the investigator submitted a motion on April 18, 2023, to amend, complete, and initiate a new public criminal prosecution against Husein Akhundov, granted by the supervising prosecutor's decision on the same day.
The public criminal prosecution against Husein Ahlimani Akhundov under Article 469, Part 3, Clause 2, Article 340, Part 2, Clause 1, and Article 335, Part 2 of the RA Criminal Code has been amended, supplemented and a new public criminal prosecution was initiated against him for illegally crossing the RA state border with prior consent by a group of persons, hiding from customs control by a group of persons with prior permission, illegally transporting firearms and ammunition across the RA state border, illegal possession of weapons by a group of persons with prior consent and for transportation, for the purpose of facilitating the commission of another crime and for the purpose of facilitating the commission of another crime and for the publicly dangerous acts of illegally depriving another person of life with the motive of national hatred, intolerance and enmity (Article 469, Part 3, Clause 2, Article 340-2 of the RA Criminal Code Item 1 of Part 1, Item 2 of Article 335 and Items 10, 13 and 15 of Part 2 of Article 155).
