As a result of the large-scale investigative and administrative operations carried out within the framework of the criminal proceedings being investigated in the Department of the Military Investigative Main Department of the RA Investigative Committee, it was found out that during the aggressive war unleashed by the military and political leadership of the Republic of Azerbaijan against the Republic of Artsakh, MA with the rank of Lieutenant General, declared army under the circumstances, during the period from October 30 to November 9, 2020, during the organization of the defense of the city of Shushi and the surrounding regions, he showed a negligent attitude towards his official duties by not performing and improperly performing them, such actions negligently caused severe consequences; the armed forces of the enemy took the city of Shushi and its suburbs under their control, their units suffered casualties and wounded.

Thus. Lieutenant-General M.A., bearing personal responsibility for the preparation and readiness of subordinate troops, their use, as well as for the successful performance of the tasks assigned to the troops (forces), from October 30, 2020, during the organization of the defense operation of the city of Shushi and adjacent regions, did not to ensure the effective use of the combat capabilities of the troops (forces) and the successful completion of the assigned tasks within the set deadlines, did not monitor the implementation of the assigned readings and did not provide the necessary assistance, did not show firmness and determination in the performance of the decisions made, did not respond promptly and flexibly to the changes in the created situation, did not ensure that the troop's stability of application, continuity, operationality, harmonious and complete command.

In particular, according to the combat order he issued, Lieutenant-General M.A. did not instruct to deploy troops in the non-guarded part of the defense perimeter of the adjacent regions of Shushi and did not mention the neighbors' problems and the demarcation lines. On October 31, he did not organize the necessary protection in the right-hand section of the terrain occupied by the N unit, as well as in the area of the Shushi-Lisagor highway, in the conditions that he had under his command since October 27, a unique rifle unit consisting of 95 soldiers formed on the base of the N military unit in the direction of Shushi. The company from October 27 and 28, two separate battalions from the N army unit, consisting of a total of 365 service members, who were not involved in the execution of combat tasks during the given period, left their defense site.

In addition, until November 6, 2020, inclusive, the Ministry of Defense, while presenting the situation in the operational summaries signed by it, stated that it continued to carry out the task, including in the direction of the city of Shushi and presented the situation as controllable, under the conditions that on November 5, 2020, The enemy's groups managed to penetrate the city of Shushi. According to the latter's decision, the units above were prematurely involved in the defense operation of Shushi city and surrounding regions; in particular, on November 5, one rifle battalion of the N military unit was deployed from the Shushi-Karintak intersection to the beginning of the area called "Isahak's spring," near the arch. Still, before that, the enemy's units had already. They took under control the Karintak settlement, the section of the Shushi-Lisagor highway, the area called "Zarsli," and the deeper parts of the site called "Isahak's Spring," under such conditions, the battalion personnel did not manage to organize a stable defense, moving to the given direction, they immediately faced the danger of encirclement under and instead of protection switched to self-defense, suffering victims and wounded. At the same time, the said unit was still ready to engage in combat operations from November 1.

In addition, the Shushi defense operation did not use two separate motorized rifle regiments ready to engage in combat operations since October 15, 2020, each consisting of 250 soldiers, and units consisting of about 150 soldiers since October 20, i.e., a regular total of 650 soldiers. Army units.

In addition, the MA violated the principles of centralized management by providing sole leadership of the troops and the initiative to decide how to execute tasks assigned to subordinates. The commanders of the forces operating in the direction of Shushi, in the conditions of constantly changing events, did not have time to study their units and their locations on the spot, to apply them as necessary, to ensure the required cooperation between the branches of the regular army operating in the direction of Shushi and the militia, in several defense areas, at the filling station on the Shushi-Stepanakert highway. In the vicinity of the intersection, in the section from the given corner to the Shushi-Karintak corner, no units were deployed (a place called "Isahak Agbyur."

On November 2, 2020, in the afternoon, the enemy units bypassed the staff of their N unit from the right wing (even though the unit commander reported to the MA about not keeping the right side of the defense contour and later bypassing the enemy units through that area): Moving from the village of Sghnakh in the direction of the places called "Nabilar" and "Zarsli", the space between the city of Shushi and the Lisagor settlement, after which on November 4, around 02:00, crossing the Shushi-Lisagor highway in the areas called "Nabilar" and "Zarsli". Along the route, they passed in the direction of the valleys and heights of the site called "Isahak Aghbyur," taking control of the size, gathered their forces and advanced towards the city of Shushi, then bypassed their units located at the Shushi-Karintak intersection and on November 5, in the evening, on the Shushi-Stepanakert highway to enter the town of Shushi from the vicinity of the junction of the filling station on November 7 taking complete control of the city of Shushi and its suburbs, their units, as a result of untimely use, caused casualties and wounded.

On August 30, 2022, MA was charged under part 3 of Article 375 of the RA Criminal Code adopted on April 18, 2003 (corresponds to part 3 of Article 550 of the current RA Criminal Code, that is, official military negligence). Due to the need to choose detention as a preventive measure against the accused MA, who is at liberty, a decision was made on the same day to arrest him. The investigation is ongoing.
