Prime Minister of the Republic of Armenia Nikol Pashinyan participates in a panel discussion on the topic of “Practical or Procedural Obstacles to Maintaining Reasonable Time Limits for the Examination of Court Cases.”
He emphasized the importance of grounding the issues in their conceptual foundations. According to him, there is a need to clarify concepts in the field of justice. “I tried to find out whether justice or fairness is formulated in our reality.”
According to him, everyone demands justice and fairness, but it is essential to understand what these terms mean. “What is our public, state perception of justice and fairness?”
According to him, there are other fundamental questions, such as who is responsible for justice and how he bears that responsibility. “In the Republic of Armenia, there is one source of legitimacy: the people, and the next source is the constitution and the legal system arising from it. And if it turns out that there is a rupture between the people and the constitution, doesn’t it turn out that the established legal order has a legitimacy problem?”
According to him, establishing justice requires the state to impose certain restrictions, which will cause tensions. The solution is for the citizen to consider that he himself decided it and that the situation arises from his own actions. “We have solved the issue of the legitimacy of the government; we have not solved the issue of the legitimacy of the legal order.”
According to him, the issue of the legitimacy of the government was solved through elections, the results of which are not in doubt, but the election by which the legal order was established, the referendum, its results are in doubt, and as long as the issue is not resolved, it is decaying like a virus. “We have a problem with the legitimacy of the legal order,” he said.
